General business terms

GENERAL CONDITIONS

These general conditions are an integral part of the contract concluded by the company Greenville Experience d.o.o., Vrhovčak 61, 10430 Samobor, OIB: (hereinafter referred to as the Agency) or an authorized agency on its behalf, and the traveler or travel contractor, who submits a request for a travel package in the organization Agencies. In the event that an individual provision of the program is regulated differently from these general conditions, the provisions established in the program shall apply.

In the case of telephone or internet sales, the passenger is considered to have accepted the terms of these general terms and conditions at the time he ordered the trip by telephone or internet. The traveler can familiarize himself with the provisions of the general conditions on the website www.greenvillefarm.eu, where they are specially marked and available.

The client or passenger is any person who has made a valid reservation or purchased/paid for a package.

These general conditions do not apply to the purchase of airline tickets and the sale of tourist packages organized by other providers, where the Agency acts as an intermediary. In this case, the passenger is bound by the general conditions of the organizer or airline and international legislation in this area. These general conditions do not apply to the insurance of health insurance with assistance abroad where the Agency acts as an intermediary. In this case, the general terms and conditions of the insurance company apply.

Expressions used in these General Travel Conditions that have a gender meaning refer equally to men and women.

APPLICATION AND CONTRACT

A traveler can apply for a travel package organized by the Agency at the Agency or any authorized agency. The travel program is considered an offer. Based on the offer, the traveler is registered in writing or verbally for the selected travel package.

When checking in, the traveler will receive an Agency document (invoice/travel contract) that shows all the information about the paid tourist package and additional services, as well as the payment schedule and all possible other agreements. The passenger is obliged to review the document and, in case of discrepancies or errors, submit a complaint within one day of its issuance. It is considered that the contract was concluded by paying the first installment (advance payment). The traveler is obliged to submit the required information at the time of registration and to submit the documents required when applying for a package deal, and to make payment in accordance with the provisions of these General Terms and Conditions. In the event that the traveler does not indicate correct information at the time of check-in, he is responsible for all costs or consequences resulting from incorrect information.

Passenger registration is mandatory. It can be waived in accordance with the provisions on the cancellation of a passenger's trip. A binding application is any application that, apart from the paid 1st meal -avasns, is submitted in oral or written form, which contains the name and surname of the passenger and other participants, credit card number or identification of another payment instrument, payment or partial payment of the price of the package arrangement or other conclusive action in which it is stated that the traveler has forwarded a binding request and report.

The stated conditions do not apply to tourist packages organized by the Agency for closed groups or to tourist packages made to order (individual offers). In this case, the travel program is considered an offer and, based on the offer, the traveler registers in writing in the package by filling in a form/request specially designed based on the terms of the program or any other written confirmation. By filling out the application form or presenting the passenger's personal data, the contract is considered to have been concluded and the passenger is obliged to pay all costs in accordance with the terms of cancellation of the passenger with regard to the possible cancellation of the package deal.

In accordance with the contract, the Agency is obliged to provide the passenger with content and features as announced in the contract regarding package arrangements and to take care of the rights and interests of the passenger in accordance with good business practice.

The passenger is obliged to take care that he, his personal documents and his luggage meet the conditions established by border, customs, sanitary, monetary and administrative regulations. The Agency has the right to reject the application of a passenger whom it can assume does not fulfill these conditions or would not fulfill them during the trip.

RESERVATION AND SERVICE COSTS

For its services, the agency charges the customer the standard costs of the reservation and the costs for the composition of the offer in the sale of tourist packages separately for each reservation. The Agency can determine different reservation costs for each package. In the case of more complex offers, if desired for individual trips, the Agency can charge the traveler the reservation costs in the amount of EUR 20.00. If the traveler does not accept the offer, the cost of the reservation will not be refunded.

SALE OF AIRLINE TICKETS

The sale of airline tickets is subject to the conditions set by the carrier. The passenger is informed about the state of sale of airline tickets before or at the time of purchase by the Agency. When selling airline tickets, the Agency acts as an intermediary for contracting and payment. In this case, the passenger is bound by the general terms and conditions of the organizer or airline and international regulations in this area. The agency is not responsible for the implementation of the flight and is not responsible for the passenger's choice of carrier. The passenger himself chooses the carrier according to his wishes and criteria and is responsible for his choice. The agency is responsible for providing the traveler with all the necessary information for the trip. The traveler can get information about the products and services that the Agency provides, in person at the facility, by e-mail, phone calls and on the website.

The Agency's service ended after it mediated the passenger's confirmation of the reservation and issued the airline ticket. From that moment on, the passenger is in a direct relationship with the responsible airline. In view of the possible non-execution or lack of implementation of the flight, the passenger requests compensation for the paid air ticket directly from the carrier.

PAYMENT

The day of payment is considered the day when the traveler makes a deposit directly to the Agency or another authorized agency, or when the Agency receives the payment to the transaction account. The traveler pays 30% of the travel price at check-in. The passenger pays the rest at least 10 days before the start of the trip, unless otherwise stipulated in the Agency's document (contract, invoice). Timely payment means a confirmed booking. If the passenger does not pay within the agreed period, this means the cancellation of the package deal and the reasonable use of the provision on the cancellation of the package deal by the passenger.

The traveler undertakes to pay the difference that would result from a possible incorrect calculation on the document issued by the Agency, and the Agency undertakes to return to the traveler any overpaid amount resulting from an error in the calculation. This obligation is valid until the end of the financial year.

In the program, the Agency can determine that the traveler pays for certain services that will be performed on the spot, to his representative ("mandatory on-site surcharge"). In that case, the Agency does not act as an organizer or mediator, but only as a mediator. In this case, the passenger carries out all claims on the spot exclusively from the service provider.

If the travel package arrangement is reserved for a passenger, with an authorized agency, the authorized travel agency is also subject to all the provisions of this point.

PRICES

The prices of the tourist package are determined by the program and are valid from the date of publication until the change of the program. The price includes the services listed in the tourist package. The price valid for the passenger is the price on the day of issuing the contract/invoice.

In accordance with the applicable law, the Agency may also change this price after the conclusion of the contract due to changes in the exchange rate or due to changes in the service provider's tariffs that affect the price of the package deal. In the event of a change in the price specified in this title, the agency will notify the traveler or the authorized travel agency that made the reservation no later than 20 days before departure and issue an additional document (invoice) that the traveler must pay before departure.

The change in the price of the exchange rate is calculated as the difference in the value of that part of the costs expressed/calculated in a foreign currency and is calculated according to the exchange rate (1) of the foreign currency on the day of preparation of the package (scheduled price per offer) and (2) on the day of preparation of the price change notification ( usually 20 – 23 days before departure) The exchange rate of the National Bank is taken into account for the conversion.

If the increase in the agreed price exceeds 8 percent of the price of the package deal, the consumer can withdraw from the contract without compensation. In this case, the agency will return the amount paid to the passenger.

Likewise, in the tourist package arrangement program, the Agency sets a basic price for a certain number of passengers, which can be changed in the event that a smaller number of passengers sign up for the trip. The agency states this additional price in the program in the form of a "mandatory surcharge in the case of a group size of from/to persons". The agency will charge the initial price of the trip upon registration. If the conditions for a price change under the title "smaller group" arise, the passenger cannot deviate from the contract because he was aware of this at check-in.

PRICES OF AIRLINE TICKETS

The prices of the products listed on the website and advertising materials are informative in nature. Exact prices of individual products are given to passengers in the office, by phone or e-mail. The prices received by the passenger in the offer include fees and taxes, unless otherwise provided for by the nature of the service or product. Air ticket prices mediated by the Agency are valid only on the day of booking! The airline ticket can be issued within a certain period, but the airline reserves the right to change the price.

ARRANGEMENTS IN WHICH THE AGENCY IS NOT THE ORGANIZER

In case the Agency is not the organizer of the package, it acts as an intermediary. In this case, the information obtained from the organizer of the tourist package is provided to the traveler and helps him register. The terms of registration, payment and possible cancellation of the package deal are in accordance with the valid terms and conditions of the tour operator. The organizer of the tourist package is listed on the Agency's document. It is considered that the Agency sells such tourist packages in someone else's name and for someone else's account. A possible complaint is settled by the traveler with the travel organizer, and the Agency provides all the necessary assistance.

SPECIAL SERVICES

Special services are those services that are not included in the price of the package (single room, special meals, other additional charges if desired...) or there are additional charges in the program (visas, other costs, etc.), which the traveler pays separately, unless otherwise stated in the program stated.

In the event that special services are provided in a certain tourist package, the traveler will express his wishes for these services at the time of registration and pay for them in addition to the price of the trip. The published prices of special services are valid only in case of contracting and paying for these services when registering for the trip. During the trip, the traveler pays for special services to the tour guide or Agency representative at the place where the service is provided, in the appropriate currency, and if it is still possible to register during the trip, at the price valid on the spot.

If the traveler himself applies for a tourist package, he can allow the Agency to find him a fellow traveler with whom he will share a room or who is willing to share his room. However, an individual registered passenger needs to be charged for a single room at check-in. In case it is determined that the traveler can share a room, the supplement for a single room will be refunded to the traveler after the trip. In the event that two passengers, together in a room, are registered for a tourist package, and one of them is canceled before the trip, the other passenger bears the costs of the additional surcharge if it is not possible to find another passenger.

CANCELLATION INSURANCE

At check-in, the traveler can choose to pay for travel cancellation insurance. The insurance conditions are the general conditions of the insurance company and in accordance with the valid price list.

PASSENGER'S CHANGE OF CONTRACT OR CANCELLATION OF THE TOURIST PACKAGE

The traveler has the right to request a change of the contract (e.g. change of name, additional services, change of accommodation, etc.) after its conclusion, and the Agency is obliged to check whether this is possible. In the event of a contract change at the passenger's request, the Agency may charge the passenger administrative costs for the change in the amount of EUR 20.00, unless otherwise specified in these General Terms and Conditions. In the event that additional costs arise as a result of the change (e.g. change of airline ticket), the passenger is obliged to pay them.

The traveler has the right to cancel the travel package at the agency where he registered or directly at the point of registration at the Agency. In the event that the traveler cancels the travel package, the Agency has the right to refund costs that depend on the remaining time until the start of the trip. In any case, the traveler is obliged to compensate the Agency for the administrative costs of the reservation in the amount of EUR 20.00.

If the program does not state otherwise, the canceled costs apply:

For tourist packages:

  • Cancellation up to 45 days before departure, 20% of the package price,
  • Cancellation from 44 to 30 days before departure, 30% of the package price,
  • Cancellation 29 to 22 days before departure, 50% of the package price,
  • Cancellation 21 to 15 days before departure, 80% of the package price,
  • Cancellation no later than 15 days before departure, 100% of the arrangement price.

For one-day tourist packages:

  • Cancellation up to 30 days before departure, 10% of the package price,
  • Cancellation from 29 to 22 days before departure, 20% of the package price,
  • Cancellation 21 to 15 days before departure, 30% of the package price,
  • Cancellation 14 to 8 days before departure, 50% of the package price,
  • Cancellation 7 to 1 day (24 hours) before departure, 80% of the package price,
  • Cancellation per day (less than 24 hours), 100% of the arrangement price.

Regardless of the cancellation costs mentioned above, the cancellation costs may differ if the Agency dictates the conditions for organizing the trip, which are therefore subject to the applicable conditions of sale and/or required by the business partners.

Regardless of the cancellation costs mentioned above, the cancellation costs may differ if the Agency dictates the conditions for organizing the trip, which are therefore subject to the applicable conditions of sale and/or required by the business partners.

At the time of cancellation of the tourist package before departure, the passenger must submit a written cancellation or sign a notification issued by the Agency. If the traveler refuses to sign or confirm this document, it is considered that the trip has not been cancelled.

During the trip, the passenger can cancel the travel package at his request. If the traveler interrupts the travel package during the trip, he has no right to reimbursement of costs or refund, neither in part nor in full. If the traveler changes the travel program within the program that is an integral part of the contract with the Agency, the traveler is considered to have terminated the contract during the trip. In this case, the passenger is responsible for the costs and damage he caused. In the event of a program change at their own will or due to force majeure, but without reasons for which the Agency is responsible, the passenger does not have the right to request compensation or a price reduction.

The Agency may, at any time before or on the day of departure, reject a person, assessing that the passenger may endanger the health or property of himself or others, or who, on departure, was clearly influenced by alcohol, drugs or other such substances. In this case, the Agency is guided by the terms of the passenger's cancellation.

The Agency has the right to demand that the passenger does not travel with the group, if he does not personally ensure that his personal documents and luggage meet the conditions established by the border, customs, sanitary, monetary and other regulations, or if he is clearly under the influence of alcohol, drugs or other such substances, or if he behaves improperly towards other passengers and his elimination is required by the group. In this case, the Agency is guided by the terms of the passenger's cancellation.

The agency will claim all damages caused by inappropriate behavior on the trip or during the duration of the package.

The amount of costs for canceling a package deal in the event that the Agency is not the travel organizer is determined by the general terms and conditions or another act of the organizer.

CHANGE OF THE PROGRAM OR CANCELLATION OF THE ORGANIZER

The agency reserves the right to terminate the package arrangement in accordance with the current legislation if the minimum number of passengers specified in the program does not sign up for the specified tourist package.

The agency notifies the passenger of the termination of the contract if the minimum number of passengers is not registered, no later than:

- 20 days before the start of the tourist package lasting longer than 6 days,

- 7 days before the start of the tourist package lasting from 2 to 6 days,

– 2 days (48 hours) before the start of the tourist package that lasts less than 2 days.

In cases where the Agency expressly guarantees the departure in writing, it cannot cancel the trip, unless the number of passengers is less than the minimum number provided for in the program.

The Agency reserves the right to fully or partially withdraw from the contract if extraordinary circumstances occur before or during the execution of the program that could not be expected, removed or avoided, if for the Agency they represent a well-founded reason why it would not conclude the contract if these circumstances existed and when concluding a contract.

The agency can cancel the contract, i.e. withdraw from the contract and demand compensation from the passenger who directly violates the provisions of the contract he concluded with it, first of all if it is established that the passenger has intentionally provided incorrect information about the number of passengers or their age, i.e. if during there were changes during the trip, and the passenger did not inform the Agency about it.

The agency reserves the right (and is not responsible) for changes in the day and time of departure, i.e. for the cancellation of the trip due to a change in the flight schedule or the occurrence of force majeure, as well as the right to change the direction of the trip if the conditions of the trip change (new schedule, unsafe position in the country in for which the program is organized, natural accidents and other unforeseen causes beyond the Agency's control), without special compensation and according to valid regulations in passenger traffic.

Liability is limited only to non-implementation of a certain part of the program, in the part that means corresponding material costs. The Agency is not responsible for non-material damages that could arise from delays, cancellations or changes in transportation or means of transportation. The agency cannot take responsibility for program changes due to the occurrence of any force majeure during the trip. In these cases, passengers can be provided with services in a changed form with regard to existing possibilities and/or another facility of the same or higher category.

In the event that the Agency cancels the travel package, the traveler has the right to a full refund of the paid price of the arrangement, but is not entitled to a refund of visa costs or vaccination costs, which were required by the program. The Agency immediately informs the passenger about any subsequent change in the program.

In the event that the situation on the spot does not allow the Agency to accommodate the passenger in the ordered facility, the Agency may accommodate the passenger in the same place in another facility of the same or higher category.

CHANGES OR CANCELLATIONS OF AIRLINE TICKETS

Changing the product or service (e.g. change of date, destination...) is only possible if the conditions of the product or service allow it. Each change is associated with additional costs specified in the conditions of the product or service provider and of which the traveler was previously aware, and whether the change conditions are enabled.

The passenger has the right to cancel a product or service at any time, but at the time of cancellation the cancellation charges under the terms of each product or service will come into effect.

In the event that the airline cancels the flight, the passenger is entitled to a full refund of the price paid, but is not entitled to a refund of the cost of the visa required to enter the country of travel, the cost of the required vaccinations or the cost of the deposit paid.

In any change or cancellation, the Agency has the right to refund administrative costs in the amount of EUR 20.00.

XIV. TRAVEL DOCUMENTS

The traveler must have a valid passport or other valid document for entering the country in which or through which he is traveling. The traveler is obliged to pay attention to all the provisions on the validity of the travel document. The validity of the document is taken into account on the last day of travel. The Agency is not responsible for any inconvenience or forced interruption of the passenger's journey under this heading.

The traveler is obliged to pay attention to all the provisions on the validity of the travel document. The validity of the document is taken into account on the last day of travel. The Agency is not responsible for any inconvenience or forced interruption of the passenger's journey under this heading.

Due to the requirements in international passenger transport (plane, ship, bus...), the passenger is obliged to provide all the necessary information about all the participants of the trip, which he applies during registration. The data must be fully harmonized with the information in the official documents that the travel participants are obliged to carry with them in accordance with the rules on crossing the national border and relevant foreign legislative acts. In the event that incorrect information causes delay, additional costs or trip interruption for other trip participants, the traveler is responsible for all incurred costs.

If the traveler loses his travel documents or they are stolen during the trip, and which are strictly necessary for continuing the trip or returning to his homeland, the traveler will provide new documents at his own expense. In the event that the traveler has to cancel the travel package due to the loss or theft of documents, he is not entitled to a refund of the paid package or reimbursement of costs.

NOTICES BEFORE DEPARTURE

The passenger receives the final notification no later than 5 (five) days before departure. Damage caused by the passenger due to an incomplete or incorrect address is borne by the passenger. In the event that the passenger does not receive the notification within the specified period, he is obliged to register at the check-in point and request it.

HEALTH REGULATIONS

The traveler is obliged to take the necessary vaccinations for the country of travel. In the event that certain vaccinations are listed or required in the travel program, each traveler must receive an international certificate - a yellow booklet with recorded vaccinations. The agency is not responsible for any complications or interruptions of the tourist arrangement due to the passenger's non-compliance with the health regulations of the country he is entering, as well as for the costs associated with this.

CUSTOMS AND FOREIGN EXCHANGE RULES

The traveler is obliged to comply with all customs and foreign exchange rules of the Republic of Croatia, as well as the rules of all other countries in which he travels. If the passenger cannot continue his journey due to non-compliance with the regulations, he bears all the consequences and costs incurred in connection with this for him and all other passengers.

LUGGAGE

The agency is not responsible for the transport, theft or damage of passenger luggage or other personal belongings, valuables and documents from accommodation facilities (hotel rooms, apartments, etc.) and means of transport (aircraft, buses, ships, etc.). Notification of lost or damaged personal luggage in a vehicle or hotel is submitted by the passenger directly to the service provider. Carriage of special baggage (such as bicycles, surfboards, golf equipment, skis, musical instruments, etc.) must be declared by the passenger at the time of registration and paid to the carrier in accordance with the carrier's rules, unless otherwise specified in the package. All costs or damages resulting from this will be borne by the passenger.

In the case of transportation, the passenger has the right to free transportation of a certain weight of luggage (according to the rules of the carrier), and each additional kilogram is charged to the passenger on the spot in the appropriate currency or according to the conditions of the carrier.

In the case of a low-cost carrier, the weight of baggage allocated at the time of check-in is usually lower than that allowed for regular carriers. Each additional kilogram is charged. The permitted weight of personal baggage that the passenger takes on the plane may also be lower, and the passengers are informed at the latest through a notification before departure.

 INFORMATION

The information that the passenger receives at the check-in point does not bind the Agency more than the information in the program or offer. In case of doubt, the written offer, invoice and travel contract, written information or written explanation are always considered valid.

CLAIMS OR COMPLAINTS

The passenger is obliged to report irregularities to the representative of the Agency on the spot when they appear. In the event that the complaint could be resolved on the spot (for example, insufficient cleanliness of the room, equipment, location of the room, etc.), and the passenger did not report the error or irregularities to the representative of the Agency, it is considered that the passenger has agreed to such a service and thereby lost the right to complain later. The passenger can submit a written complaint within two months from the day of improperly provided service, otherwise the Agency will not consider the content of the complaint. The objection must be justified. The passenger is therefore obliged to attach appropriate evidence and/or appropriate confirmation of the hotelier, transporter or other relevant person about the actual situation on the basis of which the passenger asserts his claim.

The agency is obliged to respond in writing to the complaint within 8 days of receipt. In the event that the incorrectness is not disputed (or if the traveler has not submitted all the necessary documents within the time required for their acquisition), the Agency is obliged to fulfill the request after receiving the full request. Until the Agency decides on the complaint, the traveler renounces the forwarding of information to other natural and legal persons or to public bulletins.

The amount of compensation is limited by the amount of the price of the paid trip or the amount of the actual value of the services not performed. This provision does not apply in the event that the Agency has the right to terminate the arrangement or change the program, in accordance with the terms of these general conditions and the law.

Regardless of the submitted complaint, the passenger is obliged to settle his obligations based on the invoices issued for the service provided in accordance with the payment schedule and all fees paid after the complaint is submitted to the passenger's personal account.

RESPONSIBILITY FOR ACCURACY OF AIR CARRIERS

The Agency is not responsible for the accuracy of air services on regular or emergency flights, as well as for aircraft delays, as well as for changes to the passenger's journey resulting from such delays. In the event that the airline cancels the flight before the start of the trip, the passenger has the right to a refund of the price paid. In case of cancellation, the traveler is not entitled to a refund of the cost of the visa required to enter the country to which he wishes to travel or the cost of vaccinations required by that country.

USE OF DATA

The traveler and the program contractor voluntarily provide personal data. Their personal data is necessary in the realization of contracted travel arrangements and is used for further communication. The agency will keep as a business secret everything it has learned about the traveler and the travel contractor and undertakes that the personal data of the traveler will not leave the country except for the purpose of making the contracted travel arrangements.

The exception to the provision of personal data to third parties refers to the conclusion of a travel insurance policy, i.e. if the traveler concludes an insurance policy, his data will be forwarded to the insurer.

The operation of the travel agency is coordinated with the General Office on Personal Data Protection and other binding legal regulations.
